1. Acceptance of Terms

By accessing or using the LendSafe platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

2. Description of Services

LendSafe provides a compliance management platform designed for mortgage brokers and lenders. Our Services include risk assessment tools, document management, device compliance monitoring, personnel tracking, and related features to help you meet regulatory requirements including the FTC Safeguards Rule and GLBA.

3. Account Registration

To use our Services, you must register for an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

4. Subscription and Payment

Our Services are provided on a subscription basis. By subscribing, you agree to:

  • Pay all applicable fees based on your selected plan
  • Pay the one-time setup fee ($250) upon initial subscription
  • Provide valid payment information through our payment processor (Stripe)
  • Automatic renewal unless cancelled before the next billing cycle

5. Free Trial

We offer a 14-day free trial for new users. No credit card is required during the trial period. At the end of the trial, you must subscribe to continue using the Services.

6. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Services
  • Interfere with or disrupt the Services or servers
  • Upload malicious code or content
  • Share your account credentials with unauthorized parties

7. Intellectual Property

The Services and all related content, features, and functionality are owned by LendSafe LLC and are protected by intellectual property laws. You retain ownership of your data but grant us a license to use it to provide the Services.

8. Disclaimer

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. LENDSAFE DOES NOT GUARANTEE THAT THE SERVICES WILL ENSURE REGULATORY COMPLIANCE. YOU ARE RESPONSIBLE FOR ENSURING YOUR COMPANY'S COMPLIANCE WITH APPLICABLE LAWS AND REGULATIONS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LENDSAFE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

10. Termination

Either party may terminate the subscription at any time. Upon termination:

  • Your access to the Services will end at the end of the current billing period
  • You may request an export of your data within 30 days
  • We may retain certain information as required by law

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Services. Continued use after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of Utah, without regard to conflict of law principles.
